The Madras High Court has restrained a Tamil magazine from linking former minister R Sakkarapani to the Palani temple land case, directing the removal of specified articles and videos from online and social media platforms until October 28.
Justice Hemant Chandangoudar passed the interim order on a suit filed by Sakkarapani against Junior Vikatan, YouTube and others. The order prevents the publication from claiming that people allegedly involved in the Palani temple land transaction are related to the former minister or that the land was purchased by him through benamis.
The case concerns the way allegations surrounding temple-linked land transactions are published and circulated while related legal proceedings remain pending. In the court proceedings, senior advocate P Wilson represented Sakkarapani, according to the Times of India report.
The judge said the publication had proceeded to suggest that an investigation into the transaction could reach the former minister. The court observed that the allegations directly concerned the plaintiff’s reputation and that allowing the material to remain in circulation during the proceedings could cause continuing prejudice that might not be adequately addressed through damages alone.
The interim directions cover the articles and videos identified in the suit. The publication was also restrained from publishing similar content until October 28. The order therefore applies both to the removal of existing material specified in the case and to further publication of comparable claims during the period set by the court.
The proceedings underline the legal tension between reporting on suspected irregularities in land transactions and protecting individuals from allegations that have not been established in court. The available report does not establish the outcome of any underlying investigation into the Palani temple land transaction, nor does it record a final judicial finding on the allegations against Sakkarapani.
The order is interim in nature and does not amount to a final determination of the claims made in the disputed publications. The next stated milestone is October 28, when the restraint will remain applicable according to the court’s direction.
