Delhi Buildings Face Action Risk as Pre-2007 Protection Ends

Older Delhi buildings and market shops facing uncertainty over expiring legal protection

Thousands of residential and commercial buildings constructed in Delhi before 2007 could face municipal action after 31 December 2026, when their temporary legal protection is due to expire, according to a report by Jagran. The development has prompted the Kamla Nagar Traders Association to seek an extension of the protection until a permanent solution is implemented.

The association has written to the Lieutenant Governor of Delhi and the Chief Minister, requesting continued relief for eligible properties. Its president, Nitin Gupta, said these properties had already received temporary relief twice, but a permanent arrangement had not been created during that period.

The report does not specify the exact number of properties covered by the protection or identify the legal notification under which the relief was granted. It states, however, that the protection applies to lakhs of residential and commercial buildings constructed before 2007 and is scheduled to end on 31 December 2026.

The approaching deadline has raised concerns among traders and residents about the future of their properties and businesses. The association said Delhi’s traditional markets support the livelihoods of lakhs of traders, shopkeepers, employees and their families, making the issue relevant beyond individual property disputes.

The traders’ body has asked the government to create a clear, transparent and practical policy for regularising eligible commercial properties. It also wants the existing protection to continue until such a policy is prepared and brought into effect.

The association has proposed a joint committee comprising representatives of the Delhi government, the Municipal Corporation of Delhi, relevant planning authorities and market organisations. According to the report, the committee could examine traders’ problems and recommend a time-bound solution.

The issue places the administration between two immediate requirements: addressing the legal and planning status of older buildings, and preventing uncertainty for established markets and the people whose livelihoods depend on them. The traders’ association has asked the government to announce a clear action plan before the current protection expires.

The next formal milestone is 31 December 2026, when the temporary legal protection mentioned in the report is scheduled to end. The government’s response to the association’s letters and whether a joint committee or permanent policy is announced will determine the next steps for affected properties.
