Pune Haveli-7 Office Flags Irregularities in 34 Property Deeds

Haveli 7 document registration irregularities reported at a Pune land registration office

The registration department has found irregularities in 34 property documents processed at Pune’s Haveli-7 Sub-Registrar Office in Vadgaon Sheri-Chandannagar and recommended administrative disciplinary action against the officials concerned, according to a report submitted to the Joint District Registrar’s Office.

The findings emerged from an inspection conducted by a team from Maharashtra’s Registration and Stamp Duty Department. The department’s report records several types of non-compliance, including differences in stamp duty and registration fees and failure to follow legal provisions governing the subdivision and consolidation of land parcels.

According to the report, 12 of the documents did not comply with provisions of the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, 1947. The same documents also involved instances where lower stamp duty had allegedly been paid and the applicable registration fee was found to be different from the amount recorded.

The inspection also identified other deficiencies in property-related documentation. Some documents did not contain the required Real Estate Regulatory Authority, or RERA, certificate. In other cases, the necessary verification of certificates for the regularisation of unauthorised layouts under the gunthewari system had not been carried out, the report stated.

The department further recorded an instance involving a development agreement for which the expected stamp duty had not been paid. A partition deed was also found to have been registered without the required amount of stamp duty, according to the findings reported by Pudhari.

The Haveli-7 office serves the Vadgaon Sheri and Chandannagar area, where land and property transactions form part of a rapidly changing urban landscape. Irregularities in document registration can affect the legal and financial position of parties to a transaction, particularly where land subdivision, development agreements, layout regularisation or partition of property is involved.

The inspection report has been forwarded to the Joint District Registrar’s Office. The registration department has recommended administrative disciplinary proceedings against the joint sub-registrars in connection with the irregularities. The supplied report does not state whether the affected documents have been cancelled, whether revised duties and fees have been recovered, or whether any criminal proceedings have been initiated.

Further action will depend on the administrative process following the submission of the inspection report, including scrutiny by the competent registration authorities and decisions on the documents and amounts identified during the inspection.
